{"id":2398,"date":"2021-03-08T12:05:40","date_gmt":"2021-03-08T12:05:40","guid":{"rendered":"http:\/\/ipflair.com\/?p=2398"},"modified":"2024-01-15T11:24:14","modified_gmt":"2024-01-15T05:54:14","slug":"what-is-a-patent","status":"publish","type":"post","link":"https:\/\/ipflair.com\/blog\/what-is-a-patent\/","title":{"rendered":"What is a Patent?"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-post\" data-elementor-id=\"2398\" class=\"elementor elementor-2398\" data-elementor-post-type=\"post\">\n\t\t\t\t<div class=\"elementor-element elementor-element-72dbe44b e-flex e-con-boxed e-con e-parent\" data-id=\"72dbe44b\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-1fd6e4cb elementor-widget elementor-widget-text-editor\" data-id=\"1fd6e4cb\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\tPatent word originates from the latin word Patere which means &#8220;<b>to lay open<\/b>&#8221; or &#8220;<b>to make available in public domain or for public inspection<\/b>&#8220;.\n\nA patent is an exclusive or negative right given by a sovereign state to the inventors for their inventions to exclude others from making, using, offering for sale, selling or importing the product or process(s) for the limited period of time.\n\nPatent provides a temporary monopoly for the product or process to the inventor for the limited period of time in the exchange of full disclosure of the invention with enablement, the best mode and know how requirements.\n\nPatent protection is a territorial right, means if an inventor is taking protection in a particular country, he\/she cannot extend his\/her rights to other jurisdictions. If inventors want to extend his\/her protection in other jurisdictions then inventors must <a href=\"https:\/\/ipflair.com\/file-a-patent-in-india\/\" target=\"_blank\" rel=\"noopener\">file a patent application<\/a> in each country where they want to protect their inventions.\n\nEvery country has their own laws or rules regarding the patent but the basic requirements are almost same.\n\n\n<p>In India patent is governed under :<\/p>\n\n<ul>\n \t<li>The Patents Act, 1970<\/li>\n \t<li>The Patents Rule, 2003<\/li>\n<\/ul>\nThe term which is granted under the patents, Act 1970 is for 20 years from the date of filing of a patent application in a patent office as per the manner prescribed under the Act or Rule, but the patent rights are enforceable from the date of grant of a patent.\n\n\n<p>The patented invention deals with the following requirements :<\/p>\nUnder Section 2(1)(m) &#8220;<b>patent<\/b>&#8221; means a patent for any <b>invention<\/b> granted under this Act.\n\nThe Requirement of<b> Invention<\/b> is defined under Section 2(1)(j) which says<b> \u201cinvention\u201d<\/b> means a <b>new product or process<\/b> involving an <b>inventive step<\/b> and <b>capable of industrial application<\/b>.\n\nSo, the invention must be <b>a new product or process<\/b>, and having <b>inventive step<\/b> and also <b>capable of industrial application<\/b>.\n\nThe Requirement of <b>inventive<\/b> step and <b>capable of industrial application<\/b> is also defined under The Patents, Act 1970.\n\n<b>Inventive step<\/b> under Section 2(1)(ja) says &#8220;<b>inventive step<\/b>&#8221; means a feature of an invention that involves technical advance as compared to the existing knowledge or having economic significance or both and that makes the invention not obvious to the person skilled in the art.\n\n<b>Capable of industrial application<\/b> under Section 2(1)(ac) says \u201c<b>capable of industrial application<\/b>\u201d in relation to an invention, means that the invention is capable of being made or used in an industry.\n\nOne top most or can say first requirement of patented invention is &#8220;<b>Novelty<\/b>&#8220;, novelty as such not defined under the Act but it can be refer from <b>New invention<\/b> which is defined under Section 2(1)(l) says that &#8220;<b>new invention<\/b>&#8221; means any invention or technology which has not been anticipated by publication in any document or used in the country or elsewhere in the world before the date of filing of patent application with complete specification, i.e. the subject matter has not fallen in public domain or that it does not form part of the state of the art\n\nSo, for the patentable invention, a product or process must satisfy all the above three requirements i.e. Novelty, Inventive step and capable of industrial application requirements.\n\nIn addition, an invention also should not fall under the non patentable subject matter given under Section 3 and Section 4 of <a href=\"https:\/\/ipindia.gov.in\/writereaddata\/Portal\/IPOAct\/1_31_1_patent-act-1970-11march2015.pdf\" target=\"_blank\" rel=\"noopener\">The Patents, Act 1970<\/a>.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Patent word originates from the latin word Patere which means &#8220;to lay open&#8221; or &#8220;to make available in public domain or for public inspection&#8220;.
